Work Permits for Foreign Nationals in China: From Employer Application to a Work-Type Residence Permit
An application for a foreign national's work permit in China must be initiated by an employer in China. Once the position and applicant meet the requirements, the parties must prepare documents covering education, qualifications, criminal record, health examination, employment, and passport details, then complete the visa and work-type residence formalities.
Is the employer eligible to apply?
The job seeker cannot apply for a work permit personally. The employer must register with the Service System for Foreigners Working in China, submit the documents, provide any additional materials requested, and cooperate with checks of the originals. When you receive a job offer, establish the company's legal name, the actual place of work, the position, who will handle the application, and the expected route. An employer that merely says it will “work out the visa later” is not a suitable starting point for lawful employment.
The position, place of work, and actual employer match the application.
The organization is lawfully established and willing to assume responsibility as both applicant and employer.
The salary is no lower than the local minimum wage.
The applicant has the professional skills, knowledge, or corresponding qualifications required for the position.
Where the industry requires prior approval, the employer has confirmed the competent authority's requirements.
Categories A, B, and C cannot be determined by age alone
China's foreign worker classification generally comprises Category A for foreign high-end talent, Category B for foreign professional talent, and Category C for other foreign personnel. Category A covers talent that meets high-end, urgently needed, or market-oriented criteria. A common baseline for Category B is a bachelor's degree or above, at least two years of relevant experience, and an age of no more than 60, but the requirements may be relaxed for outstanding graduates, applicants qualifying through the points system, skilled professionals, and other policy-based cases. Category C is handled according to labor-market demand and national policy.
The processing authority determines the category from the complete application and local policy. A single age or salary threshold found in an online article cannot replace that review. Before applying, ask the employer to conduct a written preliminary assessment against the target city's current service guide, stating which eligibility route will be used and who will prepare each supporting document.
Create a document responsibility checklist

Proof of work experience: issued by a former employer or another party able to substantiate the experience.
Highest degree, professional qualification, or approval document: confirm whether an apostille, authentication, certification, or other verification is required.
Criminal record certificate: confirm the issuing authority, period covered, authentication requirements, and validity period.
Health examination certificate: use an institution and timeframe accepted by the target city.
Employment contract or certificate of appointment: clearly state the position, place of work, salary, term, and both parties.
Passport, valid visa or residence document, and a recent photograph.
Documents for accompanying family members and case-specific papers such as prior industry approvals.
Documents not in Chinese usually require a Chinese translation. On Shanghai's current service page, for example, non-Chinese documents other than the passport must be accompanied by a Chinese translation stamped by the employer; the paper originals and Chinese translations must also be uploaded as required. Translation, authentication, and original-document verification procedures may differ in other cities.
The usual sequence when the applicant is outside China
The employer confirms the eligibility route and starts the application in the system.
Both parties collect, translate, and verify documents covering education, experience, criminal record, health examination, and employment.
The employer obtains the Notification Letter of Foreigner's Work Permit in China.
The applicant applies for a Z visa in accordance with the requirements of the relevant Chinese embassy or consulate abroad.
The applicant enters China with the approved documents, registers the accommodation, and completes any local checks of original documents.
The employer continues the work permit formalities.
The applicant applies to the public security authority for a work-type residence permit within the statutory time limit.
The work permit notification, Z visa, work permit, and work-type residence permit serve different functions. Obtaining one does not mean the next will be approved automatically. At every stage, retain the application number, approval document, and current validity period so the employer and applicant do not each hold only half of the file.
Applying from inside China is not always possible
Applications may be made from inside China in certain cases, including eligible Category A talent, people changing employers while working in China without changing occupations, specified family members, and innovation, entrepreneurship, or intra-group transfers covered by local policy. The conditions listed on Shanghai's government service page apply only to local acceptance and do not mean that every city or every visa holder permits an in-country conversion.
If an in-country route is unavailable, the applicant may need to apply for the appropriate visa outside China and re-enter. Do not begin work before the formalities are complete. Tourist, business, family, or study status does not itself constitute authorization to work. Nor do offshore salary payment, overseas clients, or online delivery automatically remove compliance issues when the work is actually performed in China.
The permits still require attention after approval
Keep the actual employer, position, and work area within the scope of the permit.
When the passport, address, employer, or position changes, promptly confirm which amendment formalities apply.
Check the expiry dates of the work permit and work-type residence permit separately.
For contract renewal, allow the employer enough time to prepare the extension documents.
On leaving a job or changing employers, complete cancellation, amendment, or a new application as required.
Keep personal copies of employment contracts, salary, individual income tax, social insurance, and permit records.
Since 2024-12-1, work permit information has gradually been integrated with the social security card, but this change in the form of the documents does not alter the legal requirements of the work permit itself. Confirm with the local human resources and social security authority and work permit service office whether physical or electronic social security card functions have been enabled in the city concerned.
Differences between cities and positions
China has a unified national framework, but each city determines document details, the level at which applications are accepted, processing times, whether an in-person check is required, and local talent policies. Education, healthcare, cultural performances, news, and other sectors may also be subject to requirements from the competent industry authority. Even where job titles look similar, the actual duties and the employer's qualifications must be considered.
