Social Insurance for Foreign Employees in China

Foreign nationals legally employed in China are generally required to join the employee pension, medical, work-injury, unemployment and maternity insurance schemes. The employer handles registration; employees should check the insured location, contribution record, bilateral agreements and account arrangements after leaving a job.

Your employment relationship determines enrolment

Social insurance arrangements depend on whether you are legally employed in China and which entity is your employer. Foreign nationals hired in accordance with the law by an entity registered in China, as well as those contracted by an overseas employer and then assigned to work for a registered entity in China, fall within the scope of the Interim Measures. Short-term visitors, students and people without a lawful employment relationship cannot use commercial insurance or a salary-payment arrangement as a substitute for determining their employment and social insurance status.

  • Whether the work permit and work-type residence document are valid.

  • The parties to the employment contract or assignment relationship.

  • Who calculates and bears the salary cost.

  • The actual place of work and the place of social insurance enrolment.

  • Whether the employee comes from a country that has a social security agreement with China.

What the five social insurance schemes cover

Under the current Interim Measures, eligible foreign employees must join the basic employee pension, basic employee medical, work-injury, unemployment and maternity insurance schemes, with contributions made by the employer and employee as required. Eligibility for benefits and the way each scheme is used differ; do not rely only on a single ‘social insurance’ deduction on the payslip.

The Housing Provident Fund is separate from social insurance. Whether foreign nationals may or must contribute depends on local policy and the employer's arrangements. Check your social insurance registration after starting work

  1. Ask HR to confirm the city of enrolment and the administering authority.

  2. Obtain the first contribution month, contribution base and list of schemes.

  3. Check your name, passport number and social security number.

  4. Set up access to the local official inquiry channel or electronic social security card.

  5. Compare payslip deductions with the official contribution record month by month.

  6. Confirm how the personal account under basic medical insurance works and how to use it for treatment.

  7. Keep your work permit, contract, salary and contribution records.

The employer should complete social insurance registration within 30 days of arranging the employment documents. A payslip deduction should still be checked against the official record to confirm that it has been declared and credited. If the employer says it will ‘make it up later,’ ask what back-payment procedure applies and on what date it will be completed.

How to use a bilateral social security agreement

People from a country with a social security agreement with China may be exempt from contributions to specified schemes for a certain period under that agreement. An agreement generally does not exempt every scheme, nor does an exemption take effect automatically on the basis of nationality. Check the parts of the agreement in force, the categories of people covered, the assignment period and the required certificates.

  1. Confirm whether the agreement between China and your country is in force.

  2. Identify the categories of people and specific schemes it covers.

  3. Apply to the competent authority in your home country for a certificate of coverage or participation.

  4. Have the entity in China submit it to the authority where you are enrolled.

  5. Check the start and end dates of the exemption and the schemes not covered.

  6. Confirm the position again if the assignment is extended or your status changes.

Using medical, work-injury and maternity benefits

Designated providers, deductibles, reimbursement percentages, treatment outside the insured area and personal accounts under basic medical insurance follow the rules of the place of enrolment. After starting work, do not stop at asking whether you ‘have medical insurance’: obtain the official instructions and test your access to the inquiry system. After a work injury, seek treatment promptly, notify the employer, and preserve evidence of the incident and medical care. Work-injury determinations and benefits are subject to procedures and deadlines.

  • Record the medical insurance hotline and online portal for the place of enrolment.

  • Before treatment, check the designated hospital and any registration required for care elsewhere.

  • Keep diagnoses, invoices, itemized charges and medical records.

  • For a workplace injury, record the time, place, circumstances and witness information at the scene.

  • Check maternity benefits against the local contribution and application conditions.

Before changing jobs, leaving China or retiring

When changing employers, check the final contribution month for the former employer, the first contribution month for the new employer and any transfer between regions. Before leaving China, do not assume that the full pension personal account and medical account can simply be withdrawn. Keeping or transferring the account, terminating the relationship or lawfully claiming benefits are all subject to conditions. Ask the authority in the place of enrolment for the current options based on your nationality, contribution period and departure plans.

Reaching or approaching benefit-claiming age, cumulative contributions across cities, death or later employment in China can all affect account retention and benefit claims. Keep your social security number, full contribution history and employer details, so you do not have to rely on a former employer to find them years later.

Differences by city and employer

The overall set of insured schemes comes from national rules, but the upper and lower contribution-base limits, rates, medical benefits, service channels and Housing Provident Fund policies are implemented locally. If the employment contract is in one city, the actual work is performed in another, or the employee is assigned by an overseas entity, the place of enrolment must be determined from the genuine employment relationship.

Commercial medical insurance can supplement hospital networks, outpatient care, international departments or high-cost medical coverage, but it cannot replace social insurance required by law. Check the hospitals, reimbursement rules and documents for each system separately.

Official basis and review date

The scope of enrolment, five schemes, employer registration and social security agreements are based on the 2024 revision of the Interim Measures for Participation in Social Insurance by Foreigners Employed in China, with reference to the Guidelines for Foreign Businesspeople Working and Living in China (2025 Edition), verified through 2026-8-4. Contributions and benefits are governed by the current rules of the local human resources and social security, medical insurance and social insurance authorities in the place of enrolment.
